Rental Housing Commission (RHC)

After the Notice of Appeal is Filed...

the RHC will follow these procedures:

  1. Request from OAD the certified hearing record.
  2. Notify the parties or their representatives of the receipt of the certified file from OAD.
  3. Notify the parties of the time period for filing briefs.
  4. Schedule a hearing on the appeal and notify the parties of the date, time, and place for the hearing.
  5. Hold the hearing and determine whether all parties appeared. If the appellant does not appear for the hearing, the appeal may be dismissed.
  6. Issue a decision after the hearing. The decision may affirm, reverse, or remand the issues in the case to OAD.

Parties who find error in the RHC decision may file a motion for reconsideration within 10 business days, or petition for review with the District of Columbia Court of Appeals within 30 calendar days after the date of the RHC decision, or both.

Again, all pleadings filed with the RHC must be served to opposing parties or their representatives.

Parties may obtain a copy of the hearing tape from OAD before the certified record is received by RHC, or from RHC after it receives the certified record from OAD.

Parties desiring a transcript must designate and pay a qualified court reporting company, and RHC will transmit the duplicate tape for transcription.
