The DC Board of Real Estate is defined by the District of Columbia Second Omnibus Regulatory Act of 1998 (Omnibus), which took effect on April 20, 1999. The Omnibus Law made major changes to the DC Code Annotated Section 45-1901, et seq., (Real Estate and Business Chance Licenses).

Under section 47-2853.6-7, the law empowers the Mayor of the District of Columbia, with consent of the Council, to appoint nine members of the board. The composition of the nine-member board is as follows: three real estate brokers; two salespersons; two property managers; one attorney; and one consumer member. All real estate members must be currently licensed in DC, and the attorney member must be admitted to the DC bar and engaged in the practice of real estate law. All members must be DC residents at the time of their appointment, and during their tenure. Board members are appointed to serve a three-year term of office.
